INSTITUTIONAL RESTRUCTURING & LEGISLATIVE DRAFTING

The firm’s portfolio of institutional restructuring work involves providing legal input to institutions undertaking reform to improve service delivery and extends to drafting of the legal instruments to facilitate the restructuring. The Firm has played a key role in legislative drafting assignments in East,
Central and Southern African countries. In Kenya the firm was retained to draft the legislation under Article 71 of the Constitution of Kenya which identifies the classes of transactions involving natural resources that require parliamentary approval.

The Firm has also drafted the Water Act, 2002 and is currently engaged in drafting amendments to the Water Act. The Firm has also been retained to draft a legislation to implement the trans-boundary water resources policy in Kenya. Other key assignments include drafting regulations for the petroleum sector in Kenya on behalf of the ERC, drafting regulations for the Rural Electrification Authority, National Transport and Safety Authority, Water Resources Management Authority, drafting regulations on Public Private Partnerships for counties and a Code of Ethics and Conduct for Advocates in Kenya.
We also draft policy documents, subsidiary legislation, gazette notices, and by-laws or constitutions.
